Update: Delay to German VAT Rules for Non-EU Tour Operators

Following up on our blog post from earlier this year, we can confirm that Germany has further delayed the introduction of new rules for UK and other non-EU tour operators. It is now understood that the rules will take effect on 1 January 2023. German authorities have confirmed this deferral in writing on 1 December.

Germany announced earlier this year that it does not consider the EU TOMS rules to apply to businesses established outside the EU. That meant that non-EU tour operators would be required to register for German VAT and should pay VAT on holidays and other travel enjoyed in Germany.

It was originally intended that this new approach would start in January 2021; this was delayed until 1 January 2022 but now it seems this has been deferred again, this time to 1 January 2023.
